The Governance Support Project (GSP) funded by Multi Donor Trust Fund (MDTF) has approved a financing facility under technical assistance to the Public Private Partner Unit Planning and Development Department, Khyber Pakhtunkhwa.

 

The Governance Support Project (GSP) intends to operationalize Public Private Partnership [PPP] Unit following the promulgation of Public Private Partnership Act, 2014 under Charter of Good Governance, to provide for the participation of the private sector in the financing, construction, development, operation or maintenance of infrastructure and development projects or other related services of the Government through Concession Contracts in Public Private Partnership mode. The promotion and facilitation of PPP development within the Government of Khyber Pakhtunkhwa (GoKP), through the establishment of a PPP Unit will assist in the development and execution of high quality PPP projects. The PPP Unit will provide, all line and local governments departments interested in PPP implementation, advice and support as well as ensure transparency and fair conduct.

Governance Support Project (GSP) requires to take on board the services of a firm which shall be an International / National Level consultancy firm with relevant background and mandate to undertake the assignment. The short listing criteria are:

  • Innovative approach to public sector assignments –--------------------------------10%
  • Global knowledge and linkages/partnerships----------------------------------------10%
  • A history of associating with and convening experts at high level

conferences on particular and related and issues, resulting in

innovative insights and realistic approaches----- -----------------------------------10%

  • Key staff/team members are qualified in the field of the

assignment, with economic and PPP experience-------------------------------------30%

  • Extensive experience working with the Development Partners –------------------- 20%
  • Strong experience in other countries including Central and South Asia

and MENA region, preferably within Pakistan and sub-national government-------20%

 

The attention of interested firms is drawn to paragraph 1.9 of the World Bank’s Guidelines: Selection and Employment of Consultants [under IBRD Loans and IDA Credits & Grants] by World Bank Borrowers (Consultant Guidelines 2011).

 

The consultants may associate with other firms in the form of a joint venture or a sub consultancy to enhance their qualification. Terms of Reference: Firm

Operationalization of Public Private Partnership Unit

Background

The Govt. of Khyber Pakhtunkhwa recently adopted Public Private Partnership Act, 2014 to provide for the participation of the private sector in financing, development, operation, or maintenance of infrastructure or development projects or other related services of the Government through Concession Contracts in Public Private Partnership mode and the establishment of institutions to regulate, monitor and supervise the implementation of Public Private Partnership contracts.

Scope of Work and Deliverables:

 

The promotion and facilitation of PPP development within the Government of Khyber Pakhtunkhwa (GoKPK), through the establishment of a PPP Cell that assists in the development and execution of high quality PPP projects. Shortlisted entity will generate and provide knowledge and advice towards the execution of key PPP projects, acting as a catalyst and advocate to the PPP Steering Committee.

 

The PPP Cell will provide all line and local governments departments, interested in PPP implementation, with advice and support as well as ensure transparency and fair conduct.

 

In coordinating the establishment of a PPP Cell, an advisory consultant team is a precondition to making sure that staff are experienced and knowledgeable about relevant laws and regulations and adequately trained and supported.

 

Deliverables of the Advisory Support Program

 

  • Development of a governance structure of the PPP Unit
  • Initiation of a capacity needs assessment – providing analysis of the necessary regulatory preconditions to the successful establishment of a PPP Cell and continued fulfillment of its functions.
  • Developing a roadmap including mandate, staffing, coordination with other units, work process, and key products/solutions to be delivered by the cell. Identification of PPP Core Team , including a road map for staffing of the Cell and the work processes.
  • Coordination with the Planning and Development Department, along with establish contact and consultation with the Public Private Partnership Committee, focusing on cooperative arrangements including initial trainings and support to the PPP Cell, P & DD relevant staff and other line departments as may be required.
  • Advise in the removal of further potential obstacles / bottlenecks to PPP execution, including legal, taxation and regulatory obstructions, among others. As well as providing technical, financial, and legal expertise, to advise on common procedure practices in flagging, reviewing and removing these constraints to effective PPPs.
  • Provision of general oversight of the PPP Cell initiation as well as ensure efficient monitoring systems are in place for future inquiry.
  • Meeting the expectations, as a unit of expertise, of provincial government offices and other PPP stakeholders.
  • Undertaking a pilot PPP transaction as a tool for “hands-on” training for the PPP Cell.
  • Work with the government for engaging private sector enterprises in development of the province and delivering two outcome based conferences to launch and establish the public-private interaction.

Supervision and Administration Arrangements:
